Oregon employment screening law: Giving Employment References in Oregon

The Oregon lawmakers have provided certain protections to Oregon employers who give references on previous employees.

The Oregon law says that An employer disclosing job performance information to a prospective employer on request of the prospective employer or current or former employee is presumed to be acting in good faith and is immune from civil liability for the disclosure or its consequences. A lack of good faith, proved by a preponderance standard and shown by a knowingly false or deliberately misleading disclosure or a disclosure rendered with malicious purpose or in violation of the current or former employee’s civil rights, destroys the immunity. (Or.Stat. §30.178)

Oregon employment screening law: Oregon law also provides that employers cannot refuse to hire based upon a juvenile record that has been expunged.

Oregon employment screening law: Oregon At Will doctrine

In the majority of states, employees not working under an employment contract are deemed to be "at will." In Oregon At-will employees may be terminated for any reason, so long as it's not illegal. There are numerous illegal reasons for termination. Typically such reasons fall into one of two large categories: illegal discrimination or illegal termination in violation of a public policy. Generally, employees who work under an employment contract can only be terminated for reasons specified in the contract.

Please note that Federal law mandates background checks for employees who are engaged in particular industries. The Office of Inspector General of the Department of Health and Human Services maintains a list of individuals who are excluded from participation in any of its federally-funded healthcare programs. Exclusions are due to convictions for program-related fraud and patient abuse, licensing board actions and default on health education assistance loans. Therefore, employers in affected industries should check the OIG Exclusion list before hiring employees who might work in such programs.
