No Arkansas statutes have been located to restrict any private employers ability to obtain and/or use arrest records.
However, Employers must be aware of Arkansas law restricting the use of an applicant's social media account information in employment screening decisions.
On May of 2013, Governor Mike Beebe signed H.B. 1901 into law, which prohibits employers from asking employees or job applicants for social media log-in information.
Moreover, employers also may not require that current or prospective employees add a supervisor to their social media contacts (i.e., "friending"), or require that privacy settings on social media accounts be changed.
