California Pre Employment Drug Screening And Drug Testing

Reasonable accommodation. 

Employers with 25 or more employees are required to provide “reasonable accommodation”

Businesses or organizations that employ 25 or more people must provide reasonable accommodation to employees who voluntarily submit to drug or alcohol rehabilitation provided there is no undue hardship imposed on the employer.

California has laws that permit the use of marijuana for limited medical use only.

State agency awarded contracts and grants require certification that the employer  provided a drug-free awareness program. 

Employers must also have a published policy on controlled substances distributed to their employees

Public transportation drivers must be tested for controlled substances.

On-site testing is prohibited. 

Drug testing may therefore be administered only by a licensed physician and only at certified testing laboratories.

 A person who uses controlled substances may  be ineligible for workers’ compensation and unemployment benefits.

Time required for testing existing employees is considered compensable work time.

Costs for drug tests must be paid by the employer.

Employers may not discriminate by testing only certain groups of employees by race or gender for drug testing.

Nor, may they defame an employee by publicizing an employee’s positive test results.

ADA. An applicant who is taking medication for a disability is protected by the Americans With Disability act (ADA.)
