An employer is permitted to require applicants to be tested for drug and alcohol.Company Drug Free workplace Policy must list types of tests and also state that a violation is grounds for misconduct discharge.

Within seven days of receiving a positive test result, an employee/applicant can request,  and is entitled to, a retest of the same sample by a mutually agreed upon laboratory. Request for retest must be submitted within seven days of the positive test notification.

The cost of the retest will be at the expense of the applicant/employee.
If the confirmation test result is negative, the employer must reimburse the applicant for the cost.

Denial of benefits: The employee may be denied unemployment benefits for misconduct related to violations of employer’s drug-free workplace policy.

Workers’ Compensation benefits: may be reduced up to 50% if the cause of injury is due to use of intoxicants.

Drug Free Work Place Credit: Employers may also be eligible for up to a 5% reduction on workers’ compensation insurance premium for implementing compliant drug-free workplace programs.

Applicants and employees have  the right to receive written notice of the positive test result from the employer. They also must be given the opportunity  to explain and discuss the test result with a medical review officer.

Time required for testing existing employees is considered compensable work time.

Confirmation tests are required for initial positive alcohol tests.

Before adverse action can be taken, a confirmation drug test by a certified laboratory is required.

Costs for drug tests must be paid by the employer.

Employers may not discriminate by testing only certain groups of employees by race or gender for drug testing.

Nor, may they defame an employee by publicizing an employee’s positive test results.

ADA. An applicant who is taking medication for a disability is protected by the Americans With Disability act (ADA.)
