Private employers are free to implement drug testing programs at their own discretion.
Kansas employers with a drug free workplace program should have a written drug screening policy.
After an offer of employment is made, Kansas employers may require the applicant to submit to a drug test. Information obtained must be kept confidential except to supervisors or managers with a need to know, or for safety reasons.
Employees must be advised that the policy includes alcohol and controlled substance testing as a required condition of employment.
Testing and collection must be performed at certified laboratories.
Substance abuse testing with probable cause is allowed. Also, voluntary testing for an employee assistance program or similar drug or alcohol rehabilitation program is allowed.
Unemployment and or Workers’ compensation benefits may be denied for employees that are impaired due to alcohol intoxication or use of any drugs.
Time required for testing existing employees is considered compensable work time.
Costs for drug tests must be paid by the employer.
Employers may not discriminate by testing only certain groups of employees by race or gender for drug testing.
Nor, may they defame an employee by publicizing an employee’s positive test results.
