North Dakota employment screening law: Giving Employment References in North Dakota
The North Dakota legislature provided that: An employer truthfully disclosing the date of employment, pay level, job description and duties, and wage-history information to a prospective employer is immune from civil liability for the disclosure and related consequences.
An employer disclosing job performance information to a prospective employer is presumed to be acting in good faith, although the presumption of good faith may be rebutted by showing that the information disclosed was knowingly false, disclosed with reckless disregard for the truth, deliberately misleading, or rendered with a malicious purpose.
Immunity for disclosure of job performance information is also destroyed if the information is in violation of a nondisclosure agreement or was otherwise confidential under law. (See N.D. Cent. Code §34-02-18.)
North Dakota employment screening law: At Will doctrine in North Dakota
North Dakota is an employment “at will” state. Employment that has no specified term may be terminated at the will of either the employer or the employee on notice to the other unless prohibited by law.
Please note that Federal law mandates background checks for employees who are engaged in particular industries.
The Office of Inspector General of the Department of Health and Human Services maintains a list of individuals who are excluded from participation in any of its federally-funded healthcare programs.
Exclusions are due to convictions for program-related fraud and patient abuse, licensing board actions and default on health education assistance loans.
